The Conference of Interior Ministers dealt with regulations for the protection of national minorities against the use of discriminatory minority names by police authorities. I issue the following guidelines for the police authorities of the State of North Rhine-Westphalia:

1. The Basic Law, the State Constitution and the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) prohibit people, among others . disadvantage because of their lineage, race, language, origin or belief. In addition, the Council of Europe Framework Convention for the Protection of National Minorities prohibits any discrimination on grounds of belonging to a national minority.

2nd The police of the state of North Rhine-Westphalia organize their actions and demeanor in accordance with appropriate minority protection. Without prejudice to their legal obligation to authentically document information from third parties in advertisements, interrogations or reports, the police of the state of North Rhine-Westphalia do not use stigmatization, categorization or general terms for people or replacement names chosen for them.

3rd Membership in a minority is only mentioned in the internal and external reporting if it is absolutely necessary for understanding an issue or for establishing a factual reference.

4th The form and content of internal and external police language use must be kept in such a way that they do not discriminate or stir up prejudices.

5. The police of the state of North Rhine-Westphalia avoid internal and external use of any terminology that can be misused or converted by third parties to devalue people or interpreted in their meaning.

6. Media information only contains references to the participation of national minorities if there is an overwhelming interest in information or an investigative interest in individual cases.

zum Schutz nationaler Minderheiten vor Diskriminierungen

Die Innenministerkonferenz hat sich mit Regelungen zum Schutz nationaler Minderheiten vor Verwendung diskriminierender Minderheitenbezeichnungen durch Polizeibehörden befasst. Für die Polizeibehörden des Landes Nordrhein-Westfalen erlasse ich folgende Leitlinien:

1. Grundgesetz, Landesverfassung und Europäische Konvention zum Schutz der Menschenrechte und Grundfreiheiten (EMRK) verbieten es, Menschen u.a. aufgrund ihrer Abstammung, Rasse, Sprache, Herkunft oder ihres Glaubens zu benachteiligen. Zudem verbietet das Rahmenübereinkommen des Europarates zum Schutz nationaler Minderheiten jede Diskriminierung aus Gründen der Zugehörigkeit zu einer nationalen Minderheit.

2. Die Polizei des Landes Nordrhein-Westfalen richtet ihr Handeln und Auftreten entsprechend eines angemessenen Minderheitenschutzes aus. Unbeschadet ihrer rechtlichen Verpflichtung zur authentischen Dokumentation von Angaben Dritter bei Anzeigen, Vernehmungen oder Berichten verwendet die Polizei des Landes Nordrhein-Westfalen keine Stigmatisierungen, Kategorisierungen oder pauschalen Bezeichnungen für Menschen oder dafür gewählte Ersatzbezeichnungen.

3. Auf die Zugehörigkeit zu einer Minderheit wird in der internen und externen Berichterstattung nur hingewiesen, wenn sie für das Verständnis eines Sachverhaltes oder für die Herstellung eines sachlichen Bezuges zwingend erforderlich ist.

4. Form und Inhalt des polizeilichen Sprachgebrauchs im Innen- und Außenverhältnis sind so zu halten, dass sie nicht diskriminieren oder Vorurteile schüren.

5. Die Polizei des Landes Nordrhein-Westfalen vermeidet beim internen sowie externen Gebrauch jede Begrifflichkeit, die von Dritten zur Abwertung von Menschen missbraucht bzw. umfunktioniert oder in deren Sinne interpretiert werden kann.

6. Medienauskünfte enthalten nur dann Hinweise auf eine Beteiligung nationaler Minderheiten, wenn im Einzelfall ein überwiegendes Informationsinteresse oder ein Fahndungsinteresse dazu besteht.

    LN. Nach den Massenbelästigungen in Köln brechen immer mehr Polizisten ihr Schweigen. Gewalt durch Asylbewerber soll demnach deutschlandweit systematisch verheimlicht worden sein. „Bei Straftaten von Tatverdächtigen, die eine ausländische Nationalität haben und in einer Erstaufnahmeeinrichtung gemeldet sind, legen wir den Fall auf dem Schreibtisch sofort zur Seite“, sagte ein hoher Polizeibeamter der Bild-Zeitung. „Es gibt die strikte Anweisung der Behördenleitung, über Vergehen, die von Flüchtlingen begangen werden, nicht zu berichten. Nur direkte Anfragen von Medienvertretern zu solche Taten sollen beantwortet werden.“

    Ein Sprecher des hessischen Innenministeriums bestätigte dem Blatt indirekt die Wahrheit der Aussagen: „Die Pressestellen-Leiter wurden darauf hingewiesen, daß das Thema ‚Flüchtlinge‘ von Rechtsextremisten instrumentalisiert werden könnte, um gezielt Stimmung gegen Schutzsuchende zu schüren.“

    Zahl der betroffenen Städte wächst

    Auch in Nordrhein-Westfalen sollen laut dem Bericht Straftaten von Asylanten in und um Flüchtlingsheimen nicht von der Polizei veröffentlicht worden sein. Lediglich rechtsextreme Anschläge sollten bekanntgemacht werden. In Sachsen meldete die Polizei von 19 schweren Straftaten (versuchter Totschlag oder Mord sowie sexueller mißbrauch) nur drei.
